The Trump administration has introduced a new policy requiring a $100,000 fee for first-time H-1B visa applications. Announced in a recent presidential proclamation, the new charge is aimed at reducing the use of foreign labor and encouraging companies to prioritize American workers. The policy does not apply to current H-1B holders or those renewing their visas.
Despite official clarifications, confusion remains among immigrant workers and employers. Some major tech firms like Google and Microsoft have asked overseas H-1B employees to return to the U.S. immediately out of fear of complications. Immigration lawyers warn that unclear guidance on travel and visa renewals could impact individuals filing for changes or traveling after the fee’s effective date, Sept. 21.
Employers typically pay H-1B fees, and the steep increase may discourage them from hiring foreign workers. Critics say this could negatively affect industries relying on skilled international talent, including technology and healthcare. More than 70% of H-1B holders are from India, followed by China and other countries.
The proclamation does allow for exemptions based on national security interests, but details on how to qualify for this are still unclear. Legal experts are urging workers to avoid international travel until more information is provided.
The administration has also proposed changing the H-1B selection process from a lottery system to one that favors higher-skilled and higher-paid workers.
