Why Indian Democracy Surpasses US and UK Amidst Constitutional Debate


Senior Advocate and Rajya Sabha MP Mahesh Jethmalani recently engaged in a discussion with Consulting Editor Rajdeep Sardesai on the state of India’s Constitution and democratic institutions. Jethmalani acknowledged that, despite certain flaws and areas for improvement, Indian democracy functions more effectively than that of the United States or the United Kingdom. He remarked, “Actually, if you ask me today, we are a much better functioning democracy than both the UK and the US.”

The conversation also addressed critical issues such as the role of the judiciary as a neutral arbiter, concerns regarding the influence over institutions like the Enforcement Directorate, and questions about the transparency and fairness of elections. Additionally, they explored the status of individual freedoms and protections for minority rights.

Jethmalani emphasized that the Indian Constitution has proven to be resilient over time and continues to provide room for dissent and democratic expression. He underscored the importance of strong institutions and reassured that fundamental rights remain safeguarded within the current democratic framework.

While acknowledging room for improvement, Jethmalani remained optimistic about the strength and functionality of India’s democratic setup.
