Indians Choosing EB-1A Green Cards Over H-1B Visas for Speed


Securing an H-1B visa is becoming increasingly difficult, prompting many Indian professionals to pursue the EB-1A green card route instead. Immigration experts note a significant rise in EB-1A applications due to the category’s flexibility and quicker processing timelines.

The EB-1A visa is designed for individuals with extraordinary abilities in fields such as science, arts, education, or business. Unlike the EB-2 and EB-3 green card categories, EB-1A does not require employer sponsorship or labor certification, allowing applicants to self-petition based on their accomplishments.

There has been a surge in EB-1A applications, especially among Indian nationals. This shift is partly driven by proposed H-1B changes, including a steep $100,000 filing fee, and long wait times for other green card categories. Indian professionals are increasingly leveraging their achievements—such as patents, scientific publications, industry awards, and leadership roles—to meet EB-1A eligibility requirements.

Experts emphasize that EB-1A doesn’t require global fame but rather proof of impactful contributions. Many Indian tech professionals and researchers are discovering they meet these standards due to their roles in global innovation.

Data shows that over 53,000 Indians were in the EB-1A queue by 2023. The approval rate for EB-1A remains around 60%, making it more favorable compared to alternatives like the EB-2 National Interest Waiver. As a result, EB-1A is becoming a preferred choice for those seeking a direct and faster path to U.S. permanent residency.
