Why Indians Prefer EB-1A Green Cards Over H-1B Visas

Securing an H-1B visa is becoming increasingly difficult, prompting a growing number of Indian professionals to explore alternative immigration pathways. One such route gaining traction is the EB-1A visa, which offers a faster track to U.S. permanent residency.

The EB-1A category is designed for individuals with extraordinary ability in fields such as science, technology, arts, and business. Unlike other green card categories like EB-2 and EB-3, the EB-1A does not require employer sponsorship. Instead, applicants can self-petition and must meet at least three out of ten criteria defined by U.S. Citizenship and Immigration Services (USCIS), such as awards, publications, or leadership roles.

Immigration experts note a significant rise in EB-1A applications among Indian professionals. In the first quarter of 2025, filings increased by over 50% from the previous quarter. This shift is largely due to proposed policy changes, including a proposed $100,000 H-1B filing fee and continued delays in traditional visa categories.

Attorney Sukanya Raman emphasized that EB-1A is not limited to globally famous individuals. Many Indian applicants already meet the requirements through patents, industry recognition, or key contributions within their sectors. As backlogs in EB-2 and EB-3 categories stretch for decades, especially for Indians, EB-1A offers a faster, self-directed alternative.

With a current approval rate of around 60%, the EB-1A path is proving increasingly attractive—particularly for tech professionals and entrepreneurs seeking stability amid uncertainties in the H-1B program. The ability to self-petition and avoid reliance on employer sponsorship is a major draw.
